The following conditions apply to every ZAOX machinery rental. The lessor is ZAOX Construction Machinery A.S.; the lessee is the individual or entity renting the machine.
Terminology
Rental days: the billed days of the rental period. Each day is counted in sequence; Sundays hold their position but are not billed if the rental has at least 3 billable days. Public holidays are free. Rental period: the period the lessee has paid to rent the equipment.
Pickup and return
Pickup is possible on the agreed day either in the morning (07:00–10:00, billed as a rental day) or in the afternoon (14:00–15:30, not billed). Return is possible either in the morning (07:00–09:00, not billed) or in the afternoon (14:00–15:30, billed as a rental day). Sundays are free when the rental has at least 3 billable days, and public holidays are free. Return is possible on Saturday, but in-person pickup is not.
Usage limit
Rental is based on a maximum of 8 hours of daily use. If total hours exceed 8 hours per day multiplied by the number of rental days, the lessee agrees to pay an additional fee equal to the daily rental rate divided by 8 for each extra hour.
Early return
If the lessee wishes to return the equipment before the agreed return day, they must inform the lessor in advance.
Extending the rental period
To extend the rental, the lessee must inform the lessor at least 48 hours before the end of the original period. Payment for the extended period must be made before the end of the original period.
Liability
The lessee assumes full responsibility for any damage or injury (including those caused by manufacturing or assembly defects) to persons or property resulting from use of the equipment until it is returned in accordance with the contract terms.
Equipment restrictions
The rented equipment may not be subject to any pledge, lien or encumbrance by the lessee. The lessee must immediately inform the lessor of any act or event that could jeopardise the lessor’s rights to the equipment.
No subletting
The lessee is strictly forbidden from subletting the equipment or transferring the contract to third parties.
Fuel level
The machine is delivered with a full tank of fuel at the start of the rental period. The lessee must return it with a full tank. If returned with less than a full tank, the lessee is charged for the missing fuel at the current market price per litre plus an administrative fee of 500 CZK, added to the final invoice.
Delivery report
At pickup or delivery a delivery report is completed: detailed description of the equipment (brand, model, serial number, accessories); condition with any pre-existing damage; recorded operating hours at start; fuel level; date and time of pickup; any additional accessories.
Return report
On return a return report is completed: description matching the delivery report; condition and any damage; recorded operating hours at the end; fuel level; date and time of return; notes on cleaning, repairs or other charges. Any disputes must be recorded in writing on signing, otherwise the report is deemed accepted.
Identification
On delivery or pickup the lessee must present a valid photo ID (driving licence or passport). A copy/photo of the document is kept for record-keeping purposes in compliance with applicable data-protection laws.
Payment terms
Short-term rental (60 days or less): payment by bank transfer using the variable symbol shown on the proforma invoice. A tax document is issued at the end of the rental period. Long-term rental (more than 60 days): terms agreed individually.
Warranty
All machines are covered by the lessor’s warranty for issues not caused by misuse, lack of regular checks or insufficient maintenance. Not covered: engine failure from dust/dirt; engine seizure from insufficient maintenance (dirty filter, poor/contaminated fuel, water in the tank); damage from overloading or careless handling; permanent stains (concrete, paint); damage to internal components; pin damage from missing lubrication; rollover due to operator inexperience.
Machine breakdown
In case of a component failure the lessee must immediately inform the lessor, who will replace the machine as soon as possible or arrange immediate repair/transport to base. If no replacement is available and downtime extends, the lessor reimburses the lessee for the days the machine was out of service.
Theft
In case of theft the lessee must immediately inform the lessor and file a police report. A notarised copy must be delivered within 24 hours.
Fire
If a fire occurs during use, the lessee must act immediately (using the provided extinguisher if possible) and inform the lessor at once. For an unattended fire, the lessee must inform the lessor immediately and file a police report; a certified copy must be delivered within 24 hours.
Location reporting
The lessee agrees to keep the lessor informed of the machine’s current location for the whole period: notify in writing (email or SMS) of any change of operating site; inform ZAOX within 24 hours when moving to another worksite; provide GPS coordinates or a detailed address on request.
Designated worksites
The lessee must specify 1–3 main sites where the machine will be operated. Any change of worksite must be reported to the lessor as described above.
